1. Workplace Experience Programs – Institution-Host Contract
1.1. If the Institution establishes a workplace experience program involving the Student studying or working with, for or under supervision of a third party that is not party to this Contract (“Workplace Host”), that workplace program element will not be part of the Service provided to the Student in this Contract unless this Contract expressly provides for it and includes specific provisions for it.
1.2. If a workplace experience program is made part of the Service Products in this Contract, all of the Parties’ related rights and duties – including those regarding program delivery, learning objectives, instruction, assessment, mentorship, credentialing, term periods, duration, payments, refunds, disputes or terminations – will be governed only by this Contract.
2. Termination of Workplace Experience Program – Reasons – Results
2.1. If the Student’s participation in the work experience program is terminated:
(a) only the workplace component of the service program will cease.
(b) termination will not impact this Contract or be cause alone for claims of loss or contact breach.
(c) the Institution and Student will, as this Contract provides, try to have the student move to another host relationship.
(d) the institution will provide, and the Student will continue with education service program elements that replace the work experience program.
2.2. Termination of the work program element or specific host relationship may occur because the Student, Institution or Host initiate termination – which they may do for any reason at any time before or during the work experience period.
3. Institution Contract with Third-Party Host
3.1. The Institution will contract with external third parties that will host the institution and its staff persons and students so the institution can provide the student with the work experience element of the institution and student contract.
3.2. The hosts will not be party to this institution and student contract, and the institution – not the external host – will be fully responsible for the work experience element of this institution and student contract.
3.3. The Student may find their own host and that proposed workplace host relationships will – as with all host relationships – be subject to Institution approval and the provisions set out in the following section.
4. Contractor Will Host Institution and Students
4.1.1. The third-party host contracting with the institution will – under that separate contract – host the number of students that the institution and host agree to from time to time under that separate contract.
4.1.2. Subject to the following sub-section, decisions as to what students will be hosted by a specific host will be made by the Institution under this institution and student contract.
4.1.3. The Student may accept or may decline being hosted by a specific host.
4.1.4. The host may accept or may decline being the host for specific students.
4.1.5. Hosting arrangements may be ended by the institution, host or student at any time for any reason – subject to reasonable notice.
4.1.6. If the third-party host decides to not host a specific student and the Student feels the decision was not lawful, the Institution may pursue the claim under its contract with the host.
5. Contract Link to Institution and Workplace Host Contract
5.1. The Institution will solely provide and be legally responsible for provision of the workplace program under this Contract – including regulatory approvals for general and workplace program elements – and the host will provide a service to the Institution for that purpose under a separate institution and host contract.
5.2. The host will not be party to this institution and student education service contract and will not independently provide or be responsible for provision of the work experience program to the Student.
5.3. The Institution and host will not jointly contract with the Student for the provision of the work experience program and will not be legal or joint venture partners or each others’ legal agents and affiliates.
6. Possible Student and Workplace Host Contract – Payment to Student
6.1. Any contract between the Student and Workplace Host is not part of this Contract and the Institution will not be party to any Student and Host contract.
6.2. Under this Contract, the Student will not receive payment for their participation in the workplace program.
6.3. If a separate and distinct Student and Workplace Host contract provides for payment to the Student, the Institution, not being party to that contract, will not be responsible or liable for such payment.
6.4. If the workplace experience program under this Contract is terminated as this Contract provides, the Host and worker (student) workplace contract could continue as those parties determine.
6.5. Third party funding support for workplace training or specific host-student workplace contracts is not promised by this institution-student contract.
